RUXBURY APS' GENERAL TERMS OF TRADE – Terms & Conditions
1. APPLICATION OF THESE TERMS OF TRADE
1.1 These terms of trade apply to the purchase of products on our website, ruxbury.com (hereinafter referred to as "the website").
1.2 The website is operated by Ruxbury ApS, VAT number 40 97 41 99, c/o Zenegy ApS, Slotsmarken 16, 2970 Hørsholm (hereinafter referred to as "Ruxbury").
1.3 You must accept these terms of trade before you can purchase a product from Ruxbury. Marking the checkbox "I have read and accepted the terms of trade" constitutes a legally binding agreement between you and Ruxbury.

2. SHOPPING CART
2.1 After selecting the products you wish to purchase, they are placed in the "shopping cart." You can continuously check the contents of the "shopping cart" and the total price, including any fees, shipping costs, VAT, etc., for the products. You can add or remove products from the "shopping cart" right up until the point of purchase.
3. PRICE
3.1 All prices on the website are the current retail prices, including VAT.
3.2 If Ruxbury is running a discount campaign, the discount will already be deducted from the price you can see on the website. The price you see on the website will always be the price at which you can purchase the product.
3.3 You will always be informed of the total price for the products, including any fees, shipping costs, VAT, etc., before clicking the "complete purchase" button.
4. ORDER AND ORDER CONFIRMATION
4.1 When you click the "complete purchase" button, you have placed an order for the product with Ruxbury, and you will receive a receipt confirming our receipt of your order. When Ruxbury sends you an order confirmation, a binding purchase agreement is established.
5. PAYMENT
5.1 Payment can be made using Visa, Mastercard, Visa Electron, Apple Pay, or by deducting from your PayPal account. Ruxbury does not charge fees for payment cards.
5.2 To protect your payment card information, the details are encrypted.
5.3 Ruxbury will only withdraw the amount from your account on the day we ship your products.
6. DELIVERY 6.1 On the website, you can choose how you want your product to be delivered. We offer the following delivery methods: GLS, Bring, and UPS.
7. RIGHT OF RETURN AND WITHDRAWAL
7.1 Note that the following provisions do not apply to purchases made by business entities.
7.2 You are entitled to revoke your purchase without providing a reason. Should you wish to retract your purchase and return the product, you must send an email to our customer service at info@ruxbury.com within 21 days of receiving the product. If the deadline falls on a public holiday or Saturday, the deadline is extended to the following working day.
7.3 If you contact our customer service at info@ruxbury.com before initiating the return you for selected countries buy a return label. GLS return.
7.4 You must return your product no later than 14 days after notifying Ruxbury of your intention to revoke the purchase. You should package the product securely to ensure it is not damaged upon our receipt. It is your responsibility to ensure the product reaches Ruxbury, so we recommend that you keep a postage receipt and a tracking number.
7.5 Please return the product to the following address: Kingsland Denmark Aps, Ruxbury Return, Niels Bohrs Vej 2, 7430 Ikast.
7.6 Once Ruxbury has received the returned product, we will refund both the amount you paid for the product and any our delivery costs without undue delay.
7.7 Ruxbury's refund will be made using the same payment method you used for the original purchase. The amount will be refunded no later than 14 days from the date we receive notification of your withdrawal, but the amount may be withheld until we have received the product back or you have provided evidence that the product has been returned.

8. DELAY
8.1 If Ruxbury is aware that a delay is likely to occur or if a delay seems probable, Ruxbury will inform you of this. The reason for the delay will be provided, and, to the extent possible, an estimate of when the delivery can be expected will be given.
8.2 A delayed delivery does not entitle you to compensation for any potential loss resulting from the delay.
9. CLAIMS REGARDING DEFECTS OR SHORTCOMINGS
9.1 Please note that the following provisions do not apply to purchases made by businesses.
9.2 The rules of the Sale of Goods Act concerning claims and defects are applicable.
9.3 As a consumer, you have a 2-year warranty for the purchase of products. The warranty covers defects in the product, i.e., flaws that were present at the time of delivery. However, if your product is defective, you must always file a claim within a "reasonable time" after discovering the defect. Therefore, we recommend that you promptly inspect the item for defects upon receiving it.
9.4 You can file a claim by contacting Ruxbury at info@ruxbury.com. Once we have received your valid claim, we will either repair or replace the product, or we will refund the purchase amount or provide a price reduction. Repairs or replacements will be made within a reasonable time and at no cost to you.
9.5 The return of a defective physical product must be arranged with Ruxbury in advance.
10. LIMITATION OF LIABILITY
10.1 If you are a consumer, Ruxbury assumes no additional responsibility beyond what is stipulated in the aforementioned provisions and in accordance with applicable legislation. Therefore, Ruxbury cannot be held liable for indirect damages, including data loss, operational losses, lost profits, or consequential damages.

11. FORCE MAJEURE
11.1 Neither party is responsible for damages resulting from circumstances beyond their control, such as strikes, lockouts, government actions, sabotage, natural disasters, pandemics, epidemics, currency restrictions, confiscation, war, machinery breakdown, deficiencies in deliveries from subcontractors, or delays from subcontractors, and the like. If a party wishes to invoke force majeure, the other party must be promptly informed in writing. Both parties have the right to terminate the agreement through written notice to the other party when the event in question has lasted for more than 3 months.
12. HANDLING OF PERSONAL DATA
12.1 Ruxbury processes personal data in compliance with the General Data Protection Regulation (GDPR) and data protection laws. For more information, please refer to Ruxbury's applicable data policy, which can be found on Ruxbury's website [here](link to data policy).
13. COMPLAINT PROCEDURES
13.1 If you wish to file a complaint about a product purchased from Ruxbury, you can submit a complaint to the Mediation Team for Consumer Complaints through the complaint portal for the National Complaints Board. You can access the complaint portal [here](link to complaint portal).
13.2 The European Commission's online complaint portal can also be used to file a complaint, particularly if you are a consumer residing in a different EU country than Denmark. Complaints can be submitted here:. http://ec.europa.eu/odr. When filing a complaint, please provide Ruxbury's email address, which is info@ruxbury.com.
14. DISPUTES
14.1 Any disputes shall be resolved under Danish law. The court in Helsingør is agreed upon as the legal venue.
